  • Visa rejection – Widowed mother, only son on H1

    Dear friends,
My mother’s visitor visa got rejected at the Chennai consulate yesterday. This is her first application for a US visa. I am her only kid and I am in the US on H1 for the past one and half years. The visa officer asked her how many kids she had, where they were, what company I worked for etc. She told the truth and the visa was rejected under 214b – none of the supporting documents was looked at.

I am keen to bring her here, as she is alone in India. She is a housewife and has no family ties to show in India other than her 90 year old mother. She has brothers and sisters to take care of her mother. We can show property worth Rs. 60-70 lakhs in India.

I would like to apply again for her visa. None of the conditions that make her a potential immigrant (section 214b) are going to change even in the next few months or years. Please give your advice on what is the best approach to take so that she gets a visa at least in the second attempt.

    Thanks in advance

Keep trying. She has to prove why she will come back to homecountry after the US visit.

Thanks for the reply. Can she reapply again immediately as the conditions that could have caused the visa denial are not going to change. Will getting a letter from a senator or me executing a bond saying that she will return will help or will these have a negative impact.

        Hi,

Sorry to hear that news. Mine is the same case and my mom is appearing for interview this month in Chennai.

So, do my mom need to lie that she is having 2 children? Even I am on H1, only child and I havent been to India in like 3.5 years (1.5 yrs on H1).

Please suggest. I am worried about it.

Also, if you dont mind, can you please let me know , how old your mother is? My mom is retired and aged 65. Can you also let me know what were the interview questions to your mom.

        I appreciate your help.

        Thanks.

I do not know if it is correct to lie, but even if she lies (about other ties in India) like another kid being there – be prepared to answer the related questions. The related questions can be - where is that kid working/studying, what is his/her name, what is the contact no etc. I personally know a case where the consulate called up the given no. to verify if the things stated during the interview were correct.

As I had stated in my initial post, my mother was asked only a couple of questions. She is 63 years old.

The interviews of June 1st were delayed by many hours as they had a backlog of 31 May. My mother had her interview scheduled at 3.00 PM but it was almost 6.00 PM by the time she was called. The tired VO would have found it easier to reject than process the papers !

Wish you/your mother the best of luck.
